Public bidding urged in P930-M AFP radio deal

AN ANTICORRUPTION coalition has urged the Department of National Defense to conduct a public bidding for the purchase of 12,046 VHF/FM radios worth P930.8 million under the Armed Forces of the Philippines Modernization Program.

The Coalition Against Corruption (CAC), a regular observer of biddings at the DND, submitted its proposal on Jan. 11 to Defense Assistant Secretary Roberto Nuqui, chair of the DND bids and awards committee.

The proposal came after a Philippine Daily Inquirer special report said that the purchase of the radios had been stalled for three years and had adversely affected field communications because the DND and AFP still had to resolve whether to buy them by direct contracting or by a public bidding.

The CAC is composed of business and Church groups and several nongovernment organizations, and is headed by former Central Bank Governor Jose L. Cuisia.

The Government Procurement Policy Board earlier recommended that the radios be bought through public bidding. However, the AFP, now under Gen. Hermogenes Esperon, has stood firm on direct contracting.

The DND’s defense acquisition committee and its bids and awards committee had recommended to Avelino Cruz shortly before he resigned as defense secretary in November the purchase of the units through a negotiated procurement.

Scenarios

The CAC, through the Makati Business Club and Bishops-Businessmen’s Conference, reiterated its June 1, 2005, position that a public bidding would enable the government to realize substantial savings.

While acknowledging the AFP’s concern to ensure that the new units would be compatible with the 1,956 units it had bought earlier, the CAC noted that the 12,046 remaining units to be procured represented more than six times the original order.

In a “best case scenario” of a public bidding, the same supplier for the 1,956 units may win again but at a lower bid price, the coalition said in a statement.

In a “bad case scenario,” another supplier offering a different radio may win, making the first set of communication equipment inaccessible to the new set, the CAC said.

But the coalition said the 1,956 radios could be used just for specific areas or AFP units while the rest could be used anywhere. The AFP would then have two radio systems.

Suggestions

Reacting to other procurement problems reported by the Inquirer newspaper, the CAC recommended the following measures in the bidding of DND and AFP contracts:

• Project proponents must always be clear and unbiased in writing project specifications, not favoring any specific supplier, manufacturer or even a brand.

• Project management teams or technical working groups should do good market research to facilitate the decisions at the BAC level.

• To enhance transparency in the bidding process, a master timetable for all procurement of supplies in any agency should be readily available to the public.

The coalition also called on the government to “prosecute crooks … to complete the cycle of procurement reforms in any agency.”

“We strongly urge the Ombudsman to act judiciously on all pending cases related to procurement law violations -- especially the Commission on Elections and e-Mega Pacific bidding scam,” it said.

The Comelec had paid P1.3 billion to the Mega Pacific consortium which was judged by the Supreme Court to be ineligible, and the government has not recovered its down payment.

In October last year, however, the Ombudsman cleared all Comelec officials of any wrongdoing.


BAC Observers get bird’s eyeview of bases

14 June 2006—Observers of the Bids and Awards Committee of the Department of National Defense were invited last 30 May and 6 June 2006 to visit headquarters of two major services of the Armed Forces. The site visits were conducted to familiarize BAC members with the existing resources and capability of the AFP. Private-sector observers are regularly invited to sit in in the procurement process of the DND.

The 30 May visit included a tour of the Army warehouse with Commanding Gen. Hermogenes Esperon and DND BAC Chairman Jose F. Santos to inspect troop gear, communications equipment, and rifles. On the other hand, the 6 June tour of the Navy’s maintenance and repair facility in Sangley Point, Cavite, showed underwater apparatus and battle gear, as well as sea vessels and the Philippine Airforce’s air fleet. The tour provided observers a better perspective of the AFP’s massive logistical requirement and the urgent need to complete the AFP Modernization plan.

DND to Open Petroleum Bids
15 August 2005 - The Opening of Bids for the Supply and Delivery of Petroleum, Oil and Lubricants (POL) Requirement for the Department of National Defense Agencies and Bureaus for the 4th Quarter of 2005 and whole year 2006 will be on Wednesday, 17 August 2005, 3:00 pm at Silid Panday Pira, 1st Flr. 4 July 2005—The Department of National Defense invites prospective suppliers to apply for eligibility and to bid for the Supply and Installation of the AFP Fixed Communication System (FCS) Project. The total approved budget for the contract is Php 447,360,000. 00. Night Fighting System
